Consumer Disputes

As a consumer, whenever you purchase goods or services from a business, there are a number of legal requirements which are imposed. You will agree to their terms of service and their conditions. In turn, businesses have a duty to ensure that goods must be fit for purpose, of satisfactory quality, services must be supplied with reasonable care and skill, sold as described and comply with Trading Standard Regulations.

The legislation that applies to your case will depend on when you purchased the product. If the product was purchased before the 1st October 2015, the Sale of Goods Act 1979 applies. If you purchased it on or after the 1st October 2015, then the Consumer Rights Act 2015 applies. If you purchased the goods using credit, for example a loan agreement or using a credit card, then there may be additional protection under S.75 Consumer Credit Act 1974.

There are now four main acts of parliament which protect the rights of consumers:

Sale and Supply of Goods Act 1994

This says that all products must be of a ‘satisfactory quality’. Products must not be faulty.

Trade Descriptions Act 1968

This says that the manufacturers or retailers must not give false or misleading information about any products.

Consumer Credit Act 1974

This protects you when you borrow or buy on credit. It sets out the rules governing loans you take out and other credit services

Consumer Rights Act 2015

This Act sets out what should happen when physical goods and digital content are faulty. It allows the Trading Standards powers of redress in favour of consumers who may be the victims of breaches to their rights.

In additional to the above Acts, you may have protection under the following Acts
